Welcome to Colorado Building Plans. These Terms and Conditions (“Terms”) govern your use of the Colorado Building Plans website and, where applicable, services provided by Colorado Building Plans.

By accessing or using this website, requesting information, submitting a project inquiry, scheduling a consultation, purchasing services, or otherwise engaging Colorado Building Plans, you acknowledge that you have read and agree to these Terms.

If you do not agree with these Terms, please do not use this website or its services.

1. About Colorado Building Plans

Colorado Building Plans provides residential building design, drafting, planning, visualization, permit-related, and related services for homeowners, contractors, property owners, and other clients.

Services may include, depending upon the individual project:

  • Residential remodel design

  • Home addition design

  • Accessory dwelling unit (ADU) design

  • Custom home design

  • Floor plans

  • Elevations and building sections

  • Residential drafting

  • Permit plan preparation

  • Detailed construction plans

  • 3D design and renderings

  • Existing-condition documentation

  • Design development

  • Permit facilitation

  • Contractor coordination

  • White-label plan services

  • Other residential design and planning services

The exact services provided for a particular client are determined by the applicable proposal, estimate, scope of work, service agreement, or other written agreement.

2. Website Information Is General Information

Information published on ColoradoBuildingPlans.com is provided for general informational and educational purposes.

Articles, guides, checklists, graphics, examples, cost information, code discussions, permit information, construction information, and other website content should not be considered project-specific architectural, engineering, structural, construction, financial, legal, or other professional advice.

Every property and construction project presents different conditions.

Information applicable to one Colorado municipality, county, property, structure, or project may not apply to another.

You should not make significant design, structural, construction, permitting, financial, or legal decisions solely from information appearing on this website.

3. Individual Project Agreements

These Terms govern general use of the website and the overall relationship between users and Colorado Building Plans.

Professional services for an individual project may be governed by a separate written proposal, estimate, engagement agreement, scope of work, invoice, or other project agreement.

If a project-specific written agreement conflicts with these Terms concerning the services covered by that agreement, the project-specific agreement will control concerning that conflict.

No website page, article, advertisement, email, telephone conversation, consultation, or other general communication creates an obligation to provide professional services unless Colorado Building Plans has agreed to provide those services.

4. Scope of Services

The scope of every project is limited to the services expressly included in the applicable written proposal or agreement.

Services not specifically identified as included are excluded unless subsequently added in writing.

Additional services may require additional fees.

Changes requested after design or drafting work has begun may also result in additional fees, revised schedules, or both.

5. Client Responsibilities

Clients are responsible for providing complete and accurate information reasonably necessary for their projects.

Depending upon the project, this information may include:

  • Property information

  • Existing plans and drawings

  • Surveys

  • Photographs

  • Measurements

  • HOA requirements

  • Easements

  • Covenants

  • Utility information

  • Previous permits

  • Property records

  • Engineering documents

  • Contractor information

  • Desired project requirements

  • Budget information

  • Other information affecting the project

Colorado Building Plans may rely upon information supplied by clients and third parties unless otherwise agreed.

The client is responsible for promptly notifying Colorado Building Plans if information previously provided becomes inaccurate or circumstances affecting the project change.

6. Existing Conditions and Measurements

Existing buildings may contain concealed, inaccessible, undocumented, modified, damaged, deteriorated, or nonconforming conditions that cannot reasonably be identified during ordinary design or measurement activities.

Walls, floors, ceilings, foundations, roofs, utilities, structural components, and other building elements may conceal conditions that become apparent only after demolition or construction begins.

Unless specifically included within the project’s scope of services, Colorado Building Plans does not warrant the accuracy of information concerning concealed or inaccessible conditions.

Discovery of unexpected existing conditions may require design revisions, engineering, additional professional services, permit revisions, or changes to construction.

7. Building Codes and Local Requirements

Building codes, zoning requirements, land-use requirements, energy codes, fire regulations, HOA requirements, utility requirements, and permitting procedures vary between jurisdictions and can change.

Colorado Building Plans will use reasonable professional efforts to prepare project documents consistent with requirements applicable to the agreed scope of services.

However, no representation or guarantee is made that a governmental agency, building department, plan reviewer, HOA, utility, fire authority, or other reviewing organization will interpret or apply every requirement in a particular manner.

A reviewing authority may require changes, additional information, engineering, reports, studies, calculations, or documentation.

8. Permits and Governmental Approval

Colorado Building Plans does not guarantee issuance of any building permit, zoning approval, variance, HOA approval, utility approval, or other governmental or third-party authorization.

Permit approval ultimately rests with the authority having jurisdiction.

A governmental agency may request revisions or additional information even when plans have been prepared carefully and in accordance with commonly accepted requirements.

Unless otherwise stated in the applicable project agreement, governmental fees, permit fees, impact fees, utility fees, review fees, inspection fees, engineering fees, and similar third-party charges are the client’s responsibility.

9. Engineering and Other Licensed Professional Services

Some projects require services from structural engineers, architects, surveyors, geotechnical engineers, energy professionals, civil engineers, or other licensed or specialized professionals.

When such services are required, they may be provided by independent third parties unless specifically included within the Colorado Building Plans project agreement.

The client is responsible for third-party professional fees unless the written project agreement expressly provides otherwise.

Colorado Building Plans does not control and is not responsible for the professional acts, omissions, schedules, determinations, or work products of independent third-party professionals.

10. No Guarantee of Construction Cost

Any discussion of construction costs, budgets, price ranges, cost per square foot, material costs, labor costs, or potential project expenses is an estimate or general planning information unless expressly stated otherwise in writing.

Construction pricing can change due to labor availability, contractor selection, material costs, site conditions, market conditions, project complexity, code requirements, engineering requirements, and other factors.

Colorado Building Plans does not guarantee that a project can be constructed for a particular amount unless such a guarantee is expressly contained in a separate written agreement.

Clients should obtain current pricing from qualified contractors before making financial commitments based upon estimated construction costs.

11. Contractors and Construction

Colorado Building Plans may communicate or coordinate with contractors as part of a project.

Colorado Building Plans may also provide clients with information about contractors who may be appropriate for their projects.

Unless expressly agreed otherwise in writing, Colorado Building Plans does not act as the general contractor and does not control construction means, methods, techniques, sequences, procedures, jobsite safety, contractor personnel, subcontractors, workmanship, or construction schedules.

Selection and engagement of a contractor remain the client’s responsibility.

Colorado Building Plans does not guarantee the performance, pricing, availability, licensing status, insurance coverage, workmanship, or conduct of an independent contractor or subcontractor.

Clients should independently evaluate any contractor before entering into a construction agreement.

12. Contractor Referrals

Colorado Building Plans may occasionally provide names or contact information for contractors, engineers, consultants, suppliers, or other service providers.

Providing such information does not constitute a warranty, guarantee, endorsement, or representation regarding that person’s or company’s performance.

Clients remain responsible for evaluating and selecting their own service providers.

Unless expressly disclosed otherwise, Colorado Building Plans does not become a party to a contract between a client and an independent contractor or other third-party provider.

13. 3D Renderings and Visualizations

3D renderings, conceptual illustrations, models, and other visualizations are intended to assist clients in understanding proposed designs.

They are visual representations and may not precisely represent final construction.

Colors, textures, dimensions, lighting, landscaping, furnishings, materials, fixtures, views, shadows, and other visual elements may differ from completed construction.

Construction should be based upon the applicable approved construction documents and specifications rather than solely upon renderings or conceptual images.

14. Revisions and Changes

Client-requested revisions may be subject to limitations established in the applicable project agreement.

Revisions beyond the included scope may result in additional fees.

Changes requested after substantial design development, engineering, permit submission, or governmental review may require significant additional work.

Changes caused by previously undisclosed conditions, inaccurate client information, contractor requests, governmental requirements, engineering requirements, or changes in applicable regulations may also constitute additional services.

15. Project Schedules

Any project completion date or schedule provided by Colorado Building Plans is an estimate unless expressly guaranteed in writing.

Schedules may be affected by:

  • Client response times

  • Requested revisions

  • Engineering

  • Surveys

  • Existing conditions

  • Contractor coordination

  • Governmental review

  • Permit processing

  • Third-party consultants

  • Changes in project scope

  • Unforeseen circumstances

Colorado Building Plans is not responsible for delays caused by governmental agencies, clients, contractors, consultants, utilities, HOAs, suppliers, weather, emergencies, or circumstances outside its reasonable control.

16. Payments

Fees, deposits, progress payments, retainers, and payment schedules for professional services will be identified in the applicable proposal, invoice, or project agreement.

Payments are due according to the terms stated in those documents.

Colorado Building Plans may suspend work when required payments are overdue.

Suspension of services for nonpayment may affect the project schedule.

17. Deposits, Cancellations, and Refunds

Design and drafting services involve professional time and customized work.

Deposits, retainers, progress payments, cancellation rights, and refund eligibility will be governed by the applicable project agreement.

Unless otherwise required by law or expressly agreed in writing, fees earned for services already performed are nonrefundable.

The client remains responsible for amounts owed for authorized services performed before cancellation or termination.

18. Ownership of Drawings and Designs

Unless otherwise expressly agreed in writing, drawings, plans, renderings, concepts, designs, models, details, specifications, graphics, and other design materials created by Colorado Building Plans remain the intellectual property of Colorado Building Plans or their respective creators.

Payment for services does not automatically transfer copyright ownership.

Upon payment of all amounts due, the client may receive a limited license to use the final project documents for the property and project for which they were prepared.

19. Limited Project License

Unless otherwise stated in writing, plans and design documents prepared for a client are licensed for use only for the specific project and property for which they were created.

The client may provide necessary copies to contractors, subcontractors, governmental agencies, lenders, consultants, and other parties involved with that project.

Plans may not be resold, published, commercially distributed, used for unrelated properties, or used to construct additional projects without written permission from Colorado Building Plans or the applicable copyright owner.

20. Modification of Plans by Others

If plans or documents prepared by Colorado Building Plans are modified by another person without written authorization, Colorado Building Plans is not responsible for consequences arising from those modifications.

Anyone modifying plans assumes responsibility for the changes they make and for determining whether those changes comply with applicable requirements.

21. Website Intellectual Property

Unless otherwise indicated, content appearing on ColoradoBuildingPlans.com, including text, articles, guides, graphics, logos, photographs, illustrations, downloads, page designs, and original materials, is owned by or licensed to Colorado Building Plans and is protected by applicable intellectual property laws.

Website content may be viewed and printed for ordinary personal, noncommercial use.

Content may not be systematically copied, republished, sold, scraped, reproduced, distributed, or commercially exploited without permission.

22. Photographs and Project Images

Project photographs, renderings, drawings, and examples displayed on the website may be protected by copyright.

Their appearance on the website does not grant visitors permission to copy, reproduce, publish, distribute, or commercially use them.

Where third-party materials appear, ownership remains with the respective rights holder.

25. Prohibited Website Uses

You agree not to use this website:

  • For unlawful purposes

  • To attempt unauthorized access to website systems

28. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Colorado Building Plans and its owners, employees, representatives, and agents from claims arising from your unlawful use of the website, violation of these Terms, infringement of another person’s rights, or unauthorized use or modification of materials provided by Colorado Building Plans.

This provision does not require a client to indemnify Colorado Building Plans for liability that cannot lawfully be transferred or waived.

29. Privacy

Use of personal information collected through this website is governed by the Colorado Building Plans Privacy Policy.

Users should review the Privacy Policy to understand how information may be collected, used, stored, and disclosed.

30. Electronic Communications

Any dispute concerning professional services may also be subject to dispute-resolution, venue, mediation, arbitration, or other provisions contained in the applicable project agreement.

33. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

Any invalid provision should be interpreted or modified as necessary to most closely accomplish its intended lawful purpose.

34. No Waiver

Failure by Colorado Building Plans to enforce a provision of these Terms does not constitute a waiver of that provision or any other provision.

35. Changes to These Terms

Colorado Building Plans may revise these Terms periodically to reflect changes in its website, services, business practices, or applicable requirements.

The current version will be posted on ColoradoBuildingPlans.com with an updated effective date.

Continued use of the website after revised Terms are posted constitutes acceptance of those Terms to the extent permitted by applicable law.

Changes to these website Terms do not retroactively modify a separately executed project agreement unless expressly agreed by the parties.
